HomeMy WebLinkAboutRESOLUTIONS-2009-020-R-09• 4/1 /2009 20-R-09 A RESOLUTION Authorizing the City Manager to Sign a Certification Statement for an Illinois Bicycle Grant Application for the Ladd Arboretum Bike Path WHEREAS, the Illinois Bicycle Path Grant Program is a state -financed program operated by the Illinois Department of Natural Resources; and WHEREAS, an Illinois Bicycle Path Grant can be requested for financial assistance to eligible, local units of government to assist with the acquisition, construction, and rehabilitation of public, non -motorized bicycle paths and directly related support facilities; and 9 WHEREAS, the Illinois Bicycle Path Grant Program operates on a reimbursement basis providing up to fifty percent (50%) assistance for approved project costs, with a maximum award of two hundred thousand dollars ($200,000.00); and WHEREAS, an applicant, as part of its proposal, must adopt and submit - a State of Illinois Recreational Trails Grant Programs Doc-5 Certification Statement certifying and acknowledging that it has one hundred percent (100%) of the funds necessary to complete the pending project within the required time; and WHEREAS, the City's Parks/Forestry & Recreation Department has prepared a grant proposal for the Ladd Arboretum Bike Path; and, WHEREAS, the City Council has designated four hundred thousand • dollars ($400,000.00) for reconstruction of the Ladd Arboretum's pathway system in the 2009-2010 Capital Improvement Plan. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF • THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That the foregoing recitals are hereby found as fact and made a part hereof. SECTION 2: That the City Council hereby adopts the State of Illinois Recreational Trails Grant Programs Doc-5 Certification Statement attached hereto as Exhibit A, and made a part hereof by reference. SECTION 3: That the Interim City Manager is hereby authorized to sign and the City Clerk authorized to attest to on behalf of the City of Evanston the Certification Statement and Grant Application to apply for an Illinois Bicycle Path Grant for the Ladd Arboretum Bike Path. SECTION 4: That the Interim City Manager is hereby authorized and directed to negotiate any additional conditions to the Certification Statement and Grant Application as may be determined to be in the best interests of the City. OF NATURAL RESOURCES Project Sponsor: City of Evanston P roj e ct Title: Ladd Arboretum Bike Path • As the individual duly designated to represent the Citv of Evanston I do hereby certify that the information (sponsor) presented in this grant application is true and correct. I do further certify that the project, if approved for funding, will be completed in accordance with the provisions set forth in the Recreational Trails Grant Manual and that the Citv of Evanston has (sponsor) the financial resources to initially fund 100% of the proposed project costs within the time frame imposed by the Department of Natural Resources for project execution prior to receiving grant reimbursement. It is understood that proposed projects should be completed within the time frame established in the project agreement. Failure to complete said project within the specified time frame could be cause for project termination. In addition, failure to complete a project or withdrawal of a project due to lack of performance, insufficient funds or change in recreation priorities by the applicant shall result in the ineligibility of the project applicentfor Illinois DNR grantassistance consideration in the next two (2) consecutive grant cycles. The City of Evanston hereby further certifies that 1) it will indemnify, protect and hold harmless the State of Illinois. (sponsor) Department of Natural Resources and its representatives from any and all liabilities, costs, damages or claims arising as a direct or indirect result of the actions and/or omissions of the City of Evanston or its representatives in the construction, operation or (sponsor) maintenance of the above referenced project, and 2) that adequate public notice was given and local approval solicited on the proposed project and 3) that the facility will be operated and maintained in an attractive and safe manner, and open and available to the public without regard to ra� color, sex, national origin, age, disability or place of residence in accordance with provisions of Illinois DNR trail grant program regulations This Certification Statement was duly acted upon and adopted by the City of Evanston on the day of {sponsor} (month) (year} Attested by Date: Name (printed / typed) Signature Title 0
