A RESOLUTION
Authorizing the City Manager to Enter into
An Easement Agreement with Commonwealth Edison
For an Easement to Install Electric Facilities
North of Church, West of East Railroad
WHEREAS, Commonwealth Edison (Grantee) intends to install electric
facilities North of Church Street and West of East Railroad; and
WHEREAS, the easement is located in a 10.00-foot strip of land in the
southwest part of Lot 2 in the Church Maple Resubdivision, along the western
side of East Railroad, as shown on Exhibit 'B'; and
WHEREAS, the Electric Facilities will be located so as to encroach on the
• City's (Grantor's) property; and
WHEREAS, Grantor and Grantee are desirous of entering into an
easement agreement providing for the aforedescribed encroachment of the
Electric Facilities on the Grantor's property,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That the City Manager is hereby authorized and directed to
sign, and the City Clerk hereby authorized and directed to attest on behalf of the
City, an Easement Agreement by and between the City of Evanston and
Commonwealth Edison for an easement North of Church Street and West of
• East Railroad Avenue attached as Exhibit 1 and made a part hereof.
SECTION 2: That the City Manager is hereby authorized and directed to
negotiate any additional conditions or terms of the Agreement as may be
determined to be in the best interest of the City.
SECTION 3: That this Resolution shall be in full force and effect from and
after the date of its passage and approval in the manner provided by law.
