HomeMy WebLinkAboutRESOLUTIONS-2000-079-R-000 08/08/2000 79-R-00 A RESOLUTION Authorizing the City Manager to Execute a Contract With the Lowest Responsive and Responsible Bidder For Phase VII, Contract H of The Long -Range Sewer Improvement Program WHEREAS, the Illinois Environmental Protection Agency ("IEPA") has by- pass revolving loan fund money available to defray a portion of the cost for Phase VII—The City's Long -Range Sewer Improvement Program ("Phase VII-- Contract H"); and WHEREAS, the IEPA's deadline for providing the loan to the City is September 29, 2000; and • WHEREAS, a condition precedent to award of the loan is an undertaking submitted to the IEPA by the City by September 1, 2000, that the City will award the Phase VII—Contract H to the lowest responsive, responsible bidder; and WHEREAS, consistent with the IEPA timeframe recommendations, the City advertised for bids on July 14, 2000 and will open said bids on August 23, 2000; and WHEREAS, the Evanston City Council's first scheduled meeting after the August 23, 2000 bid opening is on September 11, 2000, after the aforedescribed September 1, 2000 deadline, and WHEREAS, section 1-17-1 (A) of the City Code provides that the City • Manager can make purchases in excess of $15,000.00 without prior City Council 79-R-00 approval when, as here, there is an opportunity for a substantial economic • benefit not otherwise obtainable, and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That the City Council finds the foregoing as facts and incorporates them herein. SECTION 2: That the City Manager is hereby authorized and the City Clerk hereby authorized and directed to attest on behalf of the City of Evanston, a contract, with the lowest responsive, responsible bidder for the City's Long - Range Sewer Improvement Program, Phase VII—Contract H, the bids for which are to be opened on or about August 23, 2000. Any such contract executed shall provide as a condition precedent to its effectiveness, that the City shall have • been awarded the aforedescribed IEPA bypass revolving loan fund money. 0 SECTION 3: That the City Manager is hereby authorized and directed to negotiate any additional terms of the contract as he may determine to be in the best interest of the City. SECTION 4: That the City Manager will make a report to the City Council at the Council's September 11, 2000 meeting pursuant to section 1-17-1 (A) of the City Code regarding award and execution of this contract. SECTION 5: That this Resolution shall be in full force and effect from and after its passage and approval in the manner provided by law.
