HomeMy WebLinkAboutRESOLUTIONS-2000-049-R-005/18/00 • 49-R-00 A RESOLUTION Authorizing the City Manager to Execute an Easement Agreement with Evanston Hotel Associate, LLC For the Hotel Parcel WHEREAS, the City entered into that certain Redevelopment Agreement dated as of October 23, 1998 with AHC Evanston LLC ("AHC"), as amended by that certain First Amendment to Redevelopment Agreement dated as of November 23, 1998, that certain Second Amendment to Redevelopment Agreement dated as of June 7, 1999 and that certain Third Amendment to Redevelopment Agreement dated as of January 26, 2000 (as so amended, the "Redevelopment Agreement"); and WHEREAS, the City owns all that tract or parcel of land described on Exhibit A • attached hereto and made a part hereof (the "Hotel Parcel"). Simultaneously with the execution of this Agreement, the City is conveying the Hotel Parcel to Evanston Hotel Associates, LLC ("EHA") subject to the Redevelopment Agreement. EHA anticipates constructing a hotel (the "Hotel") on the Property; and WHEREAS, the City owns those certain tracts or parcels of real property contiguous with the Property and described on Exhibits B-1, B-2, B-3 and B-4 attached hereto and made a part hereof (the "City Property"), and in addition to the conveyance of the Hotel Parcel, the City desires to convey to EHA the following easements for the benefit of the Hotel Parcel over the City Property: (i) an easement for pedestrian and vehicular access, ingress and egress over and across a portion of the City Property described on Exhibit B-1 0 attached hereto and made a part hereof (the "Drop -Off Lane Easement Area"); (ii) an 49-R-00 • easement for pedestrian access, ingress and egress over and across a portion of the City Property described on Exhibit B-2 attached hereto and made a part hereof (the "Pedestrian Easement Area"); (iii) an easement for pedestrian and vehicular access, ingress and egress over and across a portion of the City Property described on Exhibit B-3 attached hereto and made a part hereof (the "Access Easement Area"); and (iv) an easement for the construction, maintenance and repair of a porte cochere overhang over and across a portion of the City Property described on Exhibit B-4 attached hereto and made a part hereof (the "Porte Cochere Easement Area"); and WHEREAS, it is in the best interest of the City to enter said Easement Agreement, NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: • SECTION 1: That the City Manager is hereby authorized and directed to sign, and the City Clerk hereby authorized and directed to attest on behalf of the City of Evanston, an Easement Agreement for the Hotel Parcel, attached hereto as Exhibit A and made a part hereof, by and between the City and Evanston Hotel Associates, LLC for various easements over City Property that is contiguous to the Hotel Parcel. SECTION 2: That the City Manager is hereby authorized and directed to negotiate any additional terms of the Agreement as may be determined to be in the best interests of the City. 2 • 49-R-00 • SECTION 3: That this Resolution shall be in full force and effect from and after its passage and approval in the manner provided by law.
