HomeMy WebLinkAboutRESOLUTIONS-2000-047-R-005/17/00 47-R-00 A RESOLUTION Authorizing the City Manager to Execute a Permit With the Metropolitan Water Reclamation District of Greater Chicago Allowing the City to Store Construction -Related Equipment And Materials on District Property on Ashland Avenue near Noyes Street WHEREAS, the City and the Metropolitan Water Reclamation District of Greater Chicago ("MWRD") are units of municipal government; and WHEREAS, 5 ILCS 220, The Intergovernmental Cooperation Act, provides that units of municipal government may enter into cooperative agreements with each other for • the joint exercise of municipal authority; and WHEREAS, the City, as a home rule unit, is empowered to enter into agreements pertaining to its government and affairs; and WHEREAS, the General Permit between the City to MWRD described herein below is such an agreement; and WHEREAS, the City is desirous of entering on and occupying a portion of District property on Ashland Avenue near Noyes Street for use as a contractors' staging yard in connection with the City's long-range sewer improvement program; and WHEREAS, the MWRD requires the City to execute an agreement, a General Permit, as a condition precedent to the aforedescribed use of the said MWRD land; and • WHEREAS, execution of the subject General Permit to facilitate sewer improvement program is in the best interests of the citizens of Evanston, 47-R-00 • NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: herein. SECTION 1: That the foregoing recitals are found as fact and incorporated SECTION 2: That the City Council hereby authorizes and directs the City Manager to execute, and the City Clerk to attest, a three-year permit with the MWRD for the sum of one dollar and no/100 ($1.00) permitting the City and its long-range sewer improvement contractors to use the area of approximately 51,450 square feet of MWRD property located along Ashland Avenue, near the intersection of vacated Noyes Street, and just south of property at 2222 Green Bay; in Evanston. SECTION 3: The City Manager is authorized to negotiate any additional • terms and conditions deemed to be in the public interest. SECTION 4: That this Resolution shall be in full force and effect from and after its passage and approval in the manner provided by law.
