HomeMy WebLinkAboutRESOLUTIONS-2000-016-R-000 02/28/00 16-R-00 RESOLUTION Authorizing the City Manager to Enter into an Easement Agreement With Legacy Development, Inc. for a Subsurface Footing Encroachment at the Northeast Corner of Chicago Avenue and Main Street WHEREAS, Legacy Development, Inc. ("Legacy") intends to erect a nine -story commercial/residential building with second story parking at the northeast corner of Chicago Avenue and Main Street; and WHEREAS, the west wall, along the Chicago Avenue side of the subject site has a zero setback for a portion of the west elevation (Exhibit `A'); and 0 WHEREAS, the south wall, along the Main Street side of the subject site has a zero setback for a portion of the south elevation (Exhibit `A'); and WHEREAS, the building will be supported by underground vertical load support, "cassions and footings"; and WHEREAS, "spread footing, caisson cap and caisson bell" are a certain type of footing "Legacy" deems appropriate given the soil conditions and building loads; and WHEREAS, the spread footing, caisson cap and cassion bell along the said west wall and south wall will encroach by a maximum of three feet along Chicago Avenue and one and one-half feet along Main Street on certain portions of the public way abutting the subject site; and • 16-R-00 WHEREAS, the City as grantor and "Legacy", as grantee, are desirous of entering into an easement agreement permitting the subsurface encroachment specified therein for a term of ninety-nine years, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION I: That the City Manager is hereby authorized and directed to sign the easement agreement marked as Exhibit 1, attached hereto and incorporated herein by reference. SECTION II: That this Resolution shall be in full force and effect from and after the date of its passage and approval in the manner provided by law.
