A RESOLUTION
Authorizing City Sponsorship and Filing of an
Application By Custer Street Fair, Inc. to the
Illinois Transportation Enhancement Program (ITEP),
For Funding the Landscaping At 600 Main Street
(The Main Street Metra Station)
WHEREAS, the ITEP is a federally -funded program for projects that serve
to enhance the transportation system authorized by the Transportation Equity Act
for the 21St Century, signed into law in June, 1998; and
WHEREAS, the Illinois Department of Transportation manages the ITEP
Program in Illinois; and
• WHEREAS, the Custer Street Fair, Inc. is a not -for -profit community -
based corporation which desires to undertake the landscaping of the Main Street
Metra Station ("The Station") at 600 Main Street) and the streetscape (collectively
"The Project"); and
WHEREAS, the Train Station is owned by the Union Pacific Railroad and
operated by Metra; and
WHEREAS, Custer Street Fair, Inc. has a twenty-year lease from Union
Pacific Railroad; and
WHEREAS, Custer Street Fair, Inc. has obtained the consent of Union
Pacific Railroad and Metra for The Project; and

WHEREAS, Custer Street Fair, Inc. will manage the parking and
passenger services and establish the Train Station as a Cultural Center during •
non -commuter hours; and
WHEREAS, The landscaping includes embankment wall and walls
including plantings, trees, shrubbery and ground cover, for a total cost of
$40,000, with a sponsor share of $8,000; and
WHEREAS, the Custer Street Fair, Inc. will reimburse the City for any
expenditure it may become liable for as sponsor; and
WHEREAS, ITEP monies are available to fund The Project; and
WHEREAS, ITEP requires private sector applicants, such as Custer Street
Fair, Inc., to be sponsored by a government agency; and
WHEREAS, the City of Evanston is an agency of local government which
has agreed to sponsor the ITEP application of Custer Street Fair, Inc. for The •
Project; and
WHEREAS, among the divers responsibilities of a sponsor are acquiring a
local assurance from the project sponsor to ensure commitment, providing cash
or right-of-way donation for the local government or state agency share, ensuring
necessary environmental studies and sign -off by appropriate federal, state and
local agencies, completing preliminary engineering, preparing contract plans,
performing utility relocations, completing environmental documents, clearance,
permits and mitigation, scheduling start and completion dates for all types of
work, acquiring sponsor and agency joint agreements, acquire necessary right-

of -way and easements, manage, administer and implement the project, and
maintain the project after completion; and
WHEREAS, Custer Street Fair, Inc. and the City hereby agree that they
will enter in an Agreement whereby Custer Street Fair, Inc. will assume all
responsibilities of the sponsor arising out of or connected with The Project and
will provide the City with all insurance deemed appropriate and applicable by the
City; and
WHEREAS, the said improvements, designed to enhance the
transportation system by providing and supporting alternate modes of
transportation, enhancing the transportation system through preservation of
visual and cultural resources and improving the quality of life for members of the
community, are in the best interest of the citizens of Evanston; and
• NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS:
Section1: The City of Evanston hereby agrees to sponsor and file the
application of the Custer Street Fair, Inc. to seek ITEP funding for the
landscaping portion of the street rehabilitation project.
Section 2: The City Manager is hereby authorized to sign, and the City
Clerk to attest, all documents required by, or necessary to, such sponsorship
filing.
Section 3: The City Manager is hereby further authorized to execute an
Agreement with Custer Street Fair, Inc., consistent with this Resolution 13-R-00,
• providing for Custer Street Fair, Ilnc. to perform all responsibilities imposed on the

City arising out of or connected with its sponsorship of The Project and filing of
the application. The City Manager is authorized to negotiate any additional terms
and conditions deemed in the best interest of the City.
Section 4: That this Resolution shall be in full force and effect from and
after the date of its passage and approval in the manner required by law.
