A Resolution
Authorizing the City Manager to Execute
An Extension of an Intergovernmental
Cooperation Agreement with the Chicago Transit Authority
WHEREAS, the legislature of the State of Illinois approved on April 14,
1945, the Metropolitan Transit Authority Act creating the Chicago Transit Authority ("CTA")
as a municipal corporation, for the purpose of public ownership and operation of a
transportation system in the metropolitan area of Cook County; and
WHEREAS, the security of CTA passengers, employees and property is a
matter of public concern and the provision of such security is in the public interest; and
WHEREAS, both the CTA and the Evanston Police Department CPU") desire
to develop a long range strategy for the provision of such security to CTA passengers,
employees and property; and
WHEREAS, the PD permits sworn officers to volunteer to work during off -
duty hours for municipal corporations separate and independent from the City of Evanston
("City"); and
WHEREAS, in furtherance of the provision of security to CTA passengers,
employees and property, the CTA and the City wish to provide for the use of volunteer
sworn officers; and
WHEREAS, the CTA and City are separate and independent municipal
• corporations, authorized to enter into this Agreement under the Constitution and the laws

of the State of Illinois in accordance with the provision of the Intergovernmental •
Cooperation Act, 5 ILCS 220/1 (1991),
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That the City Manager of the City of Evanston is hereby
authorized and directed to execute an extension of an Intergovernmental Cooperation
Agreement between the CTA and the City to provide security for CTA passengers,
employees and property. Said Extension to the Intergovernmental Cooperation Agreement
shall be in substantial conformity with the Extension Agreement marked as Exhibit A,
attached hereto and incorporated herein by reference.
SECTION 2: That this Resolution shall be in full force and effect from and
after the date of its passage and approval in the manner provided by law. •

INTERGOVERNMENTAL MEMORANDUM OF UNDERSTANDING
THIS Memorandum of Understanding, made and entered into as of
the day of February, 1995, by and between the CITY OF EVANSTON,
a home rule municipality and municipal corporation organized and
existing under and by virtue of the Constitution and laws of the
State of Illinois, through its Department of Police (hereinafter
referred to as the "PD"), and the CHICAGO TRANSIT AUTHORITY, a
municipal corporation and unit of local government organized and
existing under and by virtue of the Constitution and laws of the
State of Illinois (hereinafter referred to as the "CTA").
WITNESSETH:
W-1-1EREAS, the CTA and PD entered into an Intergovernmental
• Cooperation Agreement dated as of January 1, 1994 (hereinafter
referred to as "Agreement") pursuant to which participants in the
PD Voluntary Special Employment Program would provide security to
CTA passengers, employees and property under the terms and
conditions set forth in the Agreement; and
WHEREAS, Section 15 of the Agreement provides that the
Agreement shall expire on December 31, 1994, and provides further
that the Agreement cannot be extended without the written consent
cf the parties; and
WHEREAS, the parties to the Agreement are desirous of
extending the Agreement for another period of one hundred twenty
(120) days from January 1, 1995, the parties hereto and chereto
agree as follows:

NOW THEREFORE, in consideration of the covenants and mutual
covenants herein contained and contained in the Agreement, the
parties hereto and thereto agree as follows:
1. extension of Agreement. The Agreement shall be and
hereby is further extended for a period of one hundred
twenty (120) days commencing January 1, 1995 through
April 30, 1995.
2. Terms and Conditions. Except as provided herein, the
terms a:md conditions set forth in the Agreement shall
continue during the period the Agreement is extended as
provided therein.
This Memorandum further confirms the parties, understand that
should any claim or wage increase arise after the expiration or
termination of the Agreement, or any extension thereof, which
to by the Agreement, or any

relates a time period or act covered
extension thereof, the obliga--ions and/or liabilities of the
parties remain in accordance with the terms and conditions of the
Agreement, paritcularly paragraphs 7, 8 and 10 through 14.
IN WITNESS WHEREOF, the CITY OF EVANSTON has caused this
intergovernmental Memorandum of Understanding to be executed by its
Superintendent of Police, approved by the City Manager of the City
of Evanston and the City Council and its seal to be hereto affixed
and duly attested by its CLERK, and the CHICAGC TRANSIT AUTHORITY
has caused the same to be executed by the Chairman of the CHICAGC
TRANSIT AUTHORITY BOARD and duly attested to by its Secretary as to
