HomeMy WebLinkAboutRESOLUTIONS-2006-056-R-069/11 /2006 • 56-R-06 A RESOLUTION Authorizing the City Manager to Execute an Amendment to the Existing Lease with the Metropolitan Water Reclamation District of Greater Chicago for the Former Permalawn Property and Adjacent Property Referred to as North Shore Parcels 2.12 and 2.13 WHEREAS, the Metropolitan Water Reclamation District of Greater Chicago (formerly known as the Sanitary District of Chicago) entered into a Lease Agreement dated April 6, 2006, with the City of Evanston for a thirty (30) -year term beginning on May 1, 2006, and ending on April 30, 2036, for real estate located at 2222 Green Bay Road and referred to as North Shore Parcels 2.12 and 2.13 (hereinafter • "Demised Premises"); and WHEREAS, the City of Evanston had previously requested use of the Demised Premises to build trail connections along the North Shore Channel to the Green Bay Trail and -other trails along the Channel, to extend Twiggs Park, and to facilitate parking; and WHEREAS, the City has now requested that the Lease Agreement be amended to allow use of the Demised Property as an additional staging area for a Sewer Relief project until November 30, 2007; and WHEREAS, Title 1, Chapter 17, Section 4-1, of the City Code authorizes the City Council to lease real estate for any term not exceeding ninety-nine (99) years when, in its opinion, use of such real estate by the City is no longer necessary, Is appropriate, required for the use of, profitable to, or for the best interest of the City; and 56-R-06 WHEREAS, the City Council hereby finds that the proposed lease amendment for the Demised Premises is in the best interest of the City of Evanston, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: a part hereof. SECTION 1: That the foregoing recitals are found as fact and made SECTION 2: That the City Manager is hereby authorized and directed to sign, and the City Clerk hereby authorized and directed to attest, on behalf of the City- of Evanston, an Amendment to the Lease Agreement with the Metropolitan Water Reclamation District of Greater Chicago for North Shore Parcels 2.12 and 2.13 marked as Exhibit A and attached hereto and incorporated herein. SECTION 3: That the City Manager is hereby authorized and directed to negotiate any additional terms and conditions of the said Amendment to the Lease Agreement which may be in the best interests of the City. SECTION 4: That this resolution shall be in full force and effect from and after the date of its passage and approval in the manner required by law. L Lorraine H.
