HomeMy WebLinkAboutRESOLUTIONS-2004-045-R-048/23/2004 • 45-R-04 A RESOLUTION Authorizing the Interim City Manager to Sign a Supplemental Agreement with Ciorba Group, Inc. for Asbury Avenue Bridge Engineering Services WHEREAS, the City of Evanston and Ciorba Group, Inc. entered into an Agreement dated August 8, 2002 to provide Consulting Engineering Professional Services for the improvement of the existing Asbury Avenue Bridge over the CTA Yellow Line; and WHEREAS, the City has determined it is necessary for Ciorba to provide additional preliminary engineering services for said project; and • WHEREAS, the City has determined this Supplemental Agreement is in the best interest of the City; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That the Interim City Manager is hereby authorized to sign and the City Clerk hereby authorized to attest to the Supplemental Agreement with Ciorba Group, Inc. for additional Asbury Avenue Bridge Engineering Services, attached as Exhibit 1. 45-R-04 SECTION 2: That the Interim City Manager is hereby authorized • and directed to negotiate any additional conditions of the Supplemental Agreement as may be determined to be in the best interests of the City. Morton, Mayor Attest: Mary M rr C ty Clerk Adopted:Lh�Z&BV _U7 , 2004 11 • -2- SUPPLEMENT AGREEMENT FOR ENGINEERING SERVICES CITY OF EVANSTON • ASBURY AVENUE OVER CTA YELLOW LINE DESIGN ENGINEERING SERVICES ROUTE: FAU 3732 SECTION No.: 00-00215-00-BR PROJECT No.: BHM-7003(801) Jos No.: D-91-416-99 COOK COUNTY This is a SUPPLEMENTAL AGREEMENT between the CITY of Evanston, (hereinafter referred to as the "CITY") and CIORBA GROUP, INC located at 5507 North Cumberland Avenue in Chicago, Illinois, a firm of Consultants (hereinafter referred to as the "ENGINEER"). The CITY and the ENGINEER previously entered into an AGREEMENT (hereinafter referred to as the PRIME AGREEMENT), dated August 8, 2002, in which the ENGINEER agreed to provide certain professional engineering services for the improvement of the existing Asbury Avenue Bridge over the CTA Yellow Line (hereinafter referred to as the PROJECT). Construction of the PROJECT will be funded through the Federal Bridge Rehabilitation Program • administered by the Illinois Department of Transportation (hereinafter referred to as the "DEPARTMENT'). The CITY now proposes that the ENGINEER provides additional preliminary engineering services in connection with the PROJECT. U The CITY has determined that this change is in the best interest of the CITY and is authorized by law. NOW THEREFORE, the CITY and the ENGINEER, in consideration of the mutual covenants hereinafter set forth, agree to as follows: SECTION ONE — GENERAL PROVISIONS All work completed under this SUPPLEMENTAL AGREEMENT and any remaining work under the PRIME AGREEMENT shall be bound by the provisions of the PRIME AGREEMENT except as amended, hereinafter. No changes are made. SECTION TWO — SCOPE OF WORK The ENGINEER agrees to perform the following additional work: Additional coordination with the CTA regarding intergovernmental agreement and plats; and additional survey required by the CTA. N:1Contracts13212%supp#21.Supplement Engineering Services Agreement.doc SECTION THREE — PROJECT SCHEDULE r� U • • The completion date for all engineering services as shown in the PRIME AGREEMENT (Section 5 of the BASIC AGREEMENTS OF THE ENGINEER) is revised to be let in Fall 2004. SECTION FOUR — COMPENSATION The_upper limit of compensation shown in the PRIME AGREEMENT (Section 2 of BASIC AGREEMENTS OF THE CITY is increased as outlined in the attached EXHIBIT A — COST ESTIMATE OF CONSULTANT SERVICES, ESTIMATED STAFF HOURS, IN-HOUSE DIRECT COSTS and SERVICES BY OTHERS by $34,643 to a total of $138,487. The attached documentation includes an itemized list of work tasks that were not included in the original agreement. • In general, this change order is summarized by changes in scope that included additional coordination meetings with City staff, additional coordination with SBS and ComEd for construction staging and additional coordination with the CTA. In particular the coordination with the CTA included attending CTA Safety School, CTA field Meeting including additional survey obtained on CTA right-of-way.
