HomeMy WebLinkAboutRESOLUTIONS-2004-044-R-040 44-R-04 8/23/2004, 8/11/2004 A RESOLUTION Rejecting the Application for Landmark Designation of the Building at 422 Davis Street, the Georgian WHEREAS, the City has enacted a Historic Preservation Ordinance ("Ordinance"), Title 2, Chapter 9 of the City Code of the City of Evanston, 1979, as amended; and 2-9-1; and WHEREAS, the purposes of the Ordinance are set forth in Section WHEREAS, the designation of certain properties as Landmarks is a means of accomplishing these and other purposes of the Ordinance set forth in • Section 2-9-1; and WHEREAS, Section 2-9-3(G)2 of the Ordinance charges the Preservation Commission with investigating and making recommendations to the City Council or its duly authorized Committee concerning the adoption of ordinances designating areas, properties, structures, sites and objects as Landmarks and Districts with final action on landmark designation reserved to the discretion of the City Council; and WHEREAS, The Preservation Commission considered the application submitted on December 27, 2003 for the designation of the building at 422 Davis Street, known as The Georgian, as an Evanston is Landmark; and 44-R-04 WHEREAS, the Preservation Commission conducted public • hearings pursuant to proper notice on January 20, 2004, January 27, 2004, February 24, 2004, March 10, 2004, March 23, 2004, May 8, 2004, and June '14, 2004 regarding said application, pursuant to Section 2-9-5 of the Ordinance; and WHEREAS, the Preservation Commission adopted a Resolution "Requesting the City Manager to Transmit the Evanston Preservation Commission's Recommendation and Report that the City Council Designate the Building at 422 Davis Street (The Georgian) as an Evanston Landmark" at its meeting on June 14, 2004; and WHEREAS, the Planning and Development Committee of the City Council considered the Record and Recommendation of the Preservation Commission at its June 14, 2004 meeting and set a special meeting on July 29, • 2004 to consider the recommendation; and WHEREAS, at the July 29, 2004 meeting, the Planning and Development Committee received evidence from the Applicants and the Property Owner on adaptive re -use of the building, summations of the record from both, and took public comment, making a verbatim record thereof; and WHEREAS, at the July 29, 2004 meeting, the Planning and Development Committee voted to recommend City Council rejection of the application; and WHEREAS, the City Council voted at its August 16, 2004 meeting to introduce Ordinance 70-0-04 concerning designation of landmark status; and • —2— 21:0Z] • WHEREAS, the City Council considered the record of the Preservation Commission and the record and recommendation of the Planning and Development Committee at its September 13, 2004 meeting; and WHEREAS, Ordinance 70-0-04 did not receive the requisite six votes for passage at the City Council's September 13, 2004 meeting; and WHEREAS, Section 2-9-5(G)1, provides that City Council rejection of an application for landmark designation shall be by Resolution, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: The above recital's are found as facts and made a part hereof. • SECTION 2: The City Council hereby rejects designation of the building at 422 Davis Street, "The Georgian" as an Evanston Landmark. SECTION 3: That this Resolution shall be in full force and effect from and after its passage and approval in the manner provided by law. Attest: Mary P.
