HomeMy WebLinkAboutRESOLUTIONS-2004-033-R-045/18/04 • 33-R-04 _ A RESOLUTION . _ Recognizing the Mexican Consular Identification Card WHEREAS, the City of Evanston, through the Office of the Mayor, has received an official request from the Consulate General of Mexico for official recognition of the Mexican Consular Identification Card as an official form of recognition for Mexican _ u-- nationals -who resi& in the United States; and WHEREAS, most banking institutions in the United States, as well as several municipalities, including the City of Chicago, have enacted resolutions or ordinances recognizing the Mexican Consular Identification Card as an official form of • identification; and WHEREAS, the Mexican Consular Identification Card will not replace or substitute for any other form of identification required under any federal, state statute, or local ordinance, but rather will provide an additional means of identification for Mexican ,- -. __ nationals. living_in_the...United States; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Evanston, Cook County, Illinois in the exercise of its home rule powers, as follows: SECTION 1: That the recitals set forth herein above are incorporated herein by reference as the factual basis for this transaction. SECTION 2: That the Mexican Consular Identification Card, (in Spanish called • the "Matricula Consular") is hereby recognized by the City of Evanston as an official form of identification, and that each City department shall accept as valid identification of the person a "Matricula Consular" identification card issued by the Mexican Consulate. The requirements of this Resolution do not apply under circumstances where • a) a federal or state statute, administrative regulation or directive, or court decision requires the City to obtain different identification, b) a federal or state statute or administrative regulation or directive preempts local regulation of identification requirements, or c) the City would be unable to comply with a condition imposed by a funding source, which would cause the City to lose funds from that source. SECTION 3: That nothing in this Resolution is intended to prohibit City departments from a) asking for additional information from individuals in order to verify a current address or other facts that would enable the department to fulfill its responsibilities, except that this Resolution does not permit the department to require additional information solely in order to establish identification of the person, or b) using fingerprints for identification purposes under circumstances where the department also • requires fingerprints from persons who have a driver's license or state identification card.
