A RESOLUTION
Authorizing the City Manager to
Sign a Lead -Based Paint Hazard
Control Grant Agreement
WHEREAS, Cook County and the City of Evanston are home rule units of local
government as provided in Section 6 of Article VII of the 1970 Illinois Constitution; and
WHEREAS, pursuant to 735 ILCS 35/0.01 et seq. (the "Torrens Act"), the County
is permitted to establish reasonable criteria to utilize excess Torrens Indemnity Funds to
provide financial assistance to qualified applicants for lead mitigation and abatement
activities, as defined in the Lead Poisoning Prevention Act, 410 ILCS 45/1 et.seq. and
• the Lead Poisoning Prevention Code, 77 Illinois Administrative Code, Part 845.26
through 845.30 as now stated or hereafter amended (collectively, the "Act"); and
WHEREAS, the Cook County Board of Commissioners adopted Cook County
Resolution OOr-611, Resolution to Establish the Lead Poisoning Prevention Fund (the
"Resolution"), on November 21, 2000; and
WHEREAS, pursuant to the Resolution, the County Board authorized the
creation of the Lead Poisoning Prevention Fund (the "County Lead Fund") and
authorized the President of the County Board to establish a Lead Prevention Program
as well as a Lead Prevention Advisory Council ("Advisory Council") to advise the
President on program guidelines and to make recommendations for lead poisoning
prevention activities to be funded by the Lead Poisoning Prevention Fund; and

WHEREAS, pursuant to the Resolution, John H. Stroger, Jr. the President of the •
County Board, has established the Cook County Lead -Based Paint Hazard Control
Program ("Program") which is supported and administered by the Cook County
Department of Public Health ("Department") through its Lead Poisoning Prevention Unit;
and
WHEREAS, the Department has recommended that funds from the County Lead
Fund be utilized to make grants to entities which shall provide or arrange for the
provision of lead mitigation and abatement services to applicants fulfilling the criteria
established by the Department consistent with the Act ("Funds"); and
WHEREAS, the City has applied for grant funding being made available by the
County pursuant to the aforesaid Resolution; and the County, through the Department,
has considered the application of the City for Funds to be utilized for the activities •
described in the City's Project Summary, which includes a detailed description of the
lead based paint hazard reduction services to the performed with the Funds; and
WHEREAS, the County and City are desirous of entering into a Lead -Based
Paint Hazard Control Grant Agreement; and
WHEREAS, the City Council has determined it is in the best interest of the City to
enter said Agreement,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That the City Manager is hereby authorized and directed to sign,
and the City Clerk hereby authorized and directed to attest on behalf of the City of
Evanston, a Lead -Based Hazard Control Grant Agreement with Cook County. Such •

• Agreement shall be in substantial conformity with the Agreement marked as Exhibit A
attached hereto and incorporated herein by reference.
SECTION 2: That the City Manager is hereby authorized and directed to
negotiate any additional terms and conditions of the Agreement as may be determined
to be in the best interests of the City.
SECTION 3: That this Resolution shall be in full force and effect from and after
its passage and approval in the manner provided by law.
