HomeMy WebLinkAboutRESOLUTIONS-2002-076-R-02• 10/09/2002 76-R-02 A RESOLUTION Authorizing the City Manager to Execute the TARP Assignment Agreement With The Metropolitan Water Reclamation District WHEREAS, the Metropolitan Water Reclamation District ("District") Tunnel and Reservoir Plan (TARP) is designed to collect the flow from combined sewers prior to discharging to the waterways in order to significantly reduce the pollution of the waterways and provide flood relief for Chicago and neighboring communities; and WHEREAS, the District desires sole ownership, control over and access to all structures and facilities located at or connected with or involved in the operation of • TARP for the purpose of maintaining uniformity in the operation of TARP; and TARP; WHEREAS, the City of Evanston ("City") seeks connection of its local sewer to WHEREAS, conveyance of certain City sewer structures, i.e., the North Shore Channel and Noyes Street Structures at the Ladd Arboretum to the District will facilitate connection of the City's local sewer to the TARP and will facilitate operations thereafter; and WHEREAS, execution of the conveyancing document is therefore in the best interests of the citizens of Evanston, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY • OF EVANSTON, COOK COUNTY, ILLINOIS: - 1 - 76-R-02 SECTION 1: That the aforesaid recitations are found as fact. SECTION 2: That the City Manager of the City of Evanston is hereby authorized • and directed to sign and the City Clerk is hereby authorized and directed to attest on behalf of the City of Evanston the TARP Assignment Agreement for MWRD Permit No. 98-370 which conveys and quitclaims the structures described therein to the MWRD, said Agreement is attached hereto as Exhibit 1 and incorporated herein. SECTION 3: That the City Manager of the City of Evanston is hereby authorized and directed to negotiate any additional conditions or terms as are in the best interest of the City of Evanston. SECTION 4: This Resolution shall be in full force and effect from and after the date of its passage and approval in the manner provided by law. Lorraine H.
