HomeMy WebLinkAboutRESOLUTIONS-2002-065-R-020 08/05/2002 65-R-02 A RESOLUTION Authorizing the City Manager to Sign an Easement Agreement with the Board of Trustees of the First United Methodist Church of Evanston WHEREAS, the First United Methodist Church of Evanston ("FUMC") holds title to the property at the southwest corner of Hinman Avenue and Church Street; and WHEREAS, FUMC intends to build a new handicap accessible entrance with wider stairs and ramp at the Church Street entrance; and WHEREAS, the addition for the new building entrance is being built, and the new "Foundation Wall", which is necessary to support the frost footings for the new stairs, is • on the public right-of-way; and WHEREAS, the new handrails associated with the new entrance is on the public right-of-way; and WHEREAS, the easement plat is indicated on Exhibit 'A'; and WHEREAS, foundation wall and handrails are indicated on Exhibit 'B' (Proposed Site Plan prepared by Yas/Fischel Partnership, and dated June 19, 2002); and WHEREAS, the foundation wall and handrails are located so as to encroach on the City's public right-of-way to a maximum of 1.5 feet along the north property line along Church Street; and WHEREAS, the City of Evanston and FUMC are desirous of entering into an • easement agreement for the aforedescribed encroachment of the footing handrail on the public right-of-way, 65-R-02 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY • OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That the City Manager is hereby authorized and directed to sign, and the City Clerk hereby authorized and directed to attest on behalf of the City of Evanston, an Easement Agreement between the City and the First United Methodist Church of Evanston. Such Agreement shall be in substantial conformity with the Agreement marked as Exhibit A attached hereto and incorporated herein by reference. SECTION 2: That the City Manager is hereby authorized and directed to negotiate any additional terms and conditions of the leases as may be determined to be in the best interests of the City. SECTION 3: That this Resolution shall be in full force and effect from and after its passage and approval in the manner provided by law. • > <4 1 Lorraine H.
