HomeMy WebLinkAboutRESOLUTIONS-2002-004-R-02• 02/04/2002 4-R-02 A RESOLUTION Authorizing the City Manager to Execute an Agreement With Northwestern University and the Village of Skokie, Providing for the Joint and Cooperative Establishment and Operation of a Regional Alternative Fuel Authority (EVNORSKO) And For Construction and Operation of a Clean Burning Compressed Natural Gas ("CNG") Facility at the City's Municipal Service Center, 2020 Asbury Avenue WHEREAS, Article XI of the Constitution of the State of Illinois provides that the public policy of the State and the duty of each ,person are to provide and maintain a healthful environment for the benefit of this and future generations; and • WHEREAS, the establishment and operation of an alternative fuel infrastructure site on municipally -owned property in the City of Evanston will promote clean air and thereby further the public policy of Illinois to provide and maintain a healthful environment; and WHEREAS, the City of Evanston and the Village of Skokie are home rule units of local government under Article VII of the Constitution of the State of Illinois; and WHEREAS, among the powers granted to a home rule unit by Article VII, Section VI of the Constitution of the State of Illinois is that to exercise any power and perform any function pertaining to its government and affairs; and WHEREAS, a cooperative effort to fuel their fleets with clean -burning compressed natural gas ("CNG") pertains to the government and affairs of the City of Evanston and the 0 Village of Skokie in that it will benefit the air quality of the area; and 4-R-02 WHEREAS, Article VII, Section X of the Constitution of the State of Illinois allows • the City of Evanston, and the Village of Skokie, as units of local government, to contract with corporations to share services and combine functions; and WHEREAS, said Article VII, Section X of the Constitution of the State of Illinois allows the City of Evanston and the Village of Skokie to contract with Northwestern University, an Illinois corporation, to share services and combine functions by providing for construction and operation of a new CNG pumping facility in the City of Evanston; and WHEREAS, the City of Evanston, Village of Skokie, and Northwestern University, collectively, "the parties", have determined that joint action is the most effective way to accomplish the above -described purposes; and WHEREAS, execution of this Agreement is in the best interests of the citizens of • Evanston, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That the foregoing recitals are found as fact and made a part hereof. SECTION 2: That the City Manager and the City Clerk, respectively, are hereby authorized and directed to execute, attest, and deliver the EVNORSKO Agreement attached hereto as Exhibit A and made a part hereof, and such other documents as may be necessary to the herein -authorized Agreement. -2- • • • 4-R-02 SECTION 3: That the City Manager is hereby authorized and directed to negotiate any additional terms and conditions of the EVNORSKO Agreement as may be in the best interest of the City. SECTION 4: That this Resolution shall be in full force and effect from and after the date of its passage and approval in the manner required by law. C.
