HomeMy WebLinkAboutRESOLUTIONS-1999-007-R-991/7/99 • 7-R-99 A Resolution Authorizing the City Manager to Sign the Second Amendment to the Redevelopment Agreement Between the City of Evanston and AHC Evanston, LLC BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: _ That the City Manager is hereby authorized and directed to sign and the City Clerk hereby authorized to attest on behalf of the City of Evanston Second Amendment to the Redevelopment Agreement by and between the City of Evanston and AHC Evanston, LLC • (Developer). Said Agreement is marked as Exhibit A attached hereto and incorporated herein by reference. SECTION 2: That the City Manager is hereby authorized and directed to negotiate any additional terms and conditions as may be determined to be in the best interests of the City. SECTION 3 That this Resolution shall be in full force and effect from and after its passage and approval in the manner provided by law. Mayor ATTEST: i Cl rk Adopted: , 1999 11: SECOND AMENDMENT TO REDEVELOPMENT AGREEMENT • This Second Amendment to the Redevelopment Agreement is made and entered into as of the day of January 1999 by and between the City of Evanston, Illinois, a home rule unit of local government located in Cook County Illinois (the "City") and AHC Evanston, LLC ("Developer"). 1. The date in paragraph 33 as amended for the parties to finalize the environmental provisions is extended to February 15, 1999. 2. The date in paragraph 18(b) as amended for the City to deliver the survey to the Developer is extended to February 15, 1999. The date in paragraph 18(c) as amended from which the Developer shall have 45 days to notify the City of its acceptance or rejection of the title commitments and survey commence on February 15, 1999. 3. The date in paragraph 4 for the City to authorize the Developer to construct the Performing Art Center as extended to April 1, 1999. 4. The time and paragraph 2 in which the City will obtain transfer of fee simple title of Tract 2 is extended to 150 days of the execution of this Agreement. 5. In all other respects the Redevelopment Agreement is confirmed. In the event of any conflict between this Second Amendment and the Redevelopment Agreement the Second Amendment shall control. 0 • • 0 In Witness Whereof, this Second Amendment has been duly authorized, approved and executed by the date and year first above set forth.
