HomeMy WebLinkAboutRESOLUTIONS-1998-048-R-98• 48/07/98 48-R-98 A RESOLUTION Authorizing the City Manager to Sign an Extension to the Service Agreement Between the City of Evanston and Evanston Community Media Center, Inc. WHEREAS, Evanston Community Media Center, Inc. (ECMC),.a non-profit access entity, provides public, educational, and government (PEG) access programming and services, including training, management, and coordination, on the cable television system operated within the City; and WHEREAS, there has been in effect since June 24, 1996 a Service Agreement between the City and ECMC whereby the City provided certain financial support to • ECMC for ECMC's efforts in providing PEG coordination and management; and WHEREAS, the City and ECMC are desirous of extending the Service Agreement to June 24, 2000; and WHEREAS, such extension is in the best interests of the City of Evanton, NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Evanston, Cook County, Illinois: SECTION 1: That the City Manager is hereby authorized and directed to sign, and the City Clerk hereby authorized and directed to attest on behalf of the City, a two- year extension to the aforesaid Service Agreement by and between the City and ECMC. Said Agreement is marked as Exhibit A, and attached hereto, and is incorporated herein, by reference. 1 48-R-98 -= 8/07/98 • SECTION 2: That the City Manager is hereby authorized and directed to negotiate any additional conditions of the Agreement as may be determined to be in the best interests of the City. SECTION 3: That this Resolution shall be in full force and effect from and after the date of its passage and approval in the manner required by law. ATTEST: ity Clerk Adopted: 17 , 1998 2 , Mayor • EXHIBIT A Extension to SERVICE AGREEMENT • Between City of Evanston and Evanston Community Media Center, Inc. This Agreement, made this 17 day of 4u UST , 1998 is between the City of Evanston ("City"), and the Evanston Community Media Center, Inc., an Illinois nonprofit corporation ("ECMC") A. The City and ECMC entered into an Agreement commencing July 116, 1996 and ending July 15, 1998, authorized by Resolution 14-R-97, whereby the City, agreed to provide certain financial support to ECMC for ECMC's efforts in providing public, educational, and governmental (PEG) access programming and service, including training, management, and coordination. B. The City and ECMC are desirous of extending said Agreement for two • years. C. Section 20 of said Agreement provides for a two-year extension thereof by. mutual, written agreement of the City and ECMC. NOW THEREFORE, in consideration of the mutual promises and covenants set forth herein, the parties agree as follows: 1. The foregoing recitals state the facts precedent to this Extension Agreement and the intent of the City and ECMC. 2.
