HomeMy WebLinkAboutRESOLUTIONS-1997-086-R-9740 n U 11 /4/9 7 A RESOLUTION Authorizing Acquisition and/or Condemnation of 906-08 Church Street and 910-26 Church Street WHEREAS, the City Council of the City of Evanston has considered the acquisition of the real estate hereinafter described in connection with a tax increment financing redevelopment project; and WHEREAS, the City Council approved Resolution 64-R-89, and 16-R-91 authorizing acquisition of 906-08 Church Street in November, 1989, and February, 1991 respectively; and WHEREAS, the City Council restates its determination that it is necessary to • acquire said real estate for redevelopment purposes pursuant to the provisions of Section 11- • 74.4-4 and Article Seven -Eminent Domain of the Illinois Revised Statutes; and WHEREAS, the acquisition of said real estate will be for a public purpose in accordance with State Statute and hereinabove set forth; and WHEREAS, the redevelopment of the Research Park is proceeding and acquisition of the southern portion of the project area is necessary to effectuate a redevelopment proposal; and WHEREAS, the City has requested that the Illinois Legislature grant quick take powers to the City of Evanston in order to expedite said redevelopment plan; and 1 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: • SECTION 1: That it is necessary, required, desirable, and for the best interests of the City of Evanston that the real property legally described as: "Lots 5 and 6 in Dempster's Subdivision of Block 66 in the Village (now City) of Evanston in the South west 1/4 of Section 18, township 41 North, Range 14 East of the Third Principal Meridian, in Cook County, Illinois" And commonly known as 906-08 Church Street, Evanston, Illinois And "Lots 7, 8, 9, 10,11, and 12 in Dempster's Subdivision of Block 66 in Village (now City) of Evanston, in South West 1/4 of Section 18, Township 41 North, Range 14 East of the Third Principal Meridian, in Cook County, Illinois." And commonly known as 910-926 Church Street, Evanston, Illinois which said property lies wholly within the boundaries of the City of Evanston, shall be acquired for redevelopment purposes. SECTION 2: That the City Manager of the City of Evanston and/or his designee • is hereby authorized, empowered, and directed to negotiate for and behalf of the City of Evanston with the owner or owners of the hereinabove described real property for the purchase thereof by the City of Evanston. SECTION 3: That, in the event that the City Manager and/or his designee is unable to agree with the owners of the real property hereinabove described as to the compensation to be paid therefore, then the Corporation Counsel of the City of Evanston and/or the designee of the City Manager is hereby authorized to institute condemnation proceedings in the name of the City of Evanston for the purpose of acquiring title to and • 2 possession of said real property hereinabove described in accordance with the eminent • domain laws of the State of Illinois. • SECTION 4: That this Resolution shall be in full force and effect from and after the date of its passage and approval in the manner required by law.
