AUTHORIZING THE CITY MANAGER TO ENTER INTO AN INTERGOVERNMENTAL
AGREEMENT WITH THE CITY OF CHICAGO
WHEREAS, the City of Evanston has initiated a joint planning effort with the City of Chicago
for the Howard Street corridor from Sheridan Road to Ridge Avenue; and
WHEREAS, Howard Street is partially in the City of Evanston and partially in the City of
Chicago; and
WHEREAS, the planning efforts have been undertaken by representatives from the City of
Evanston, City of Chicago, Devcorp North, residents and businesses from both Evanston and
Chicago; and
WHEREAS, these planning efforts have focused upon business retention and attraction; image
and beautification and safety; and
WHEREAS, the planning efforts have identified a need to revitalize the street scape for Howard
Street from Sheridan Road to Ridge Avenue; and
WHEREAS, in order to move these planning efforts forward, there is a need to develop
conceptual design plans and engineering plans for the renovation of the Howard street scape; and
go WHEREAS, the cost of the concept design phase is estimated to be approximately $100 000.-

WHEREAS, the cost of this project phase will be shared equally by the City of Evanston and the
City of Chicago; and
WHEREAS, the City of Evanston and the City of Chicago have agreed to pay for subsequent
phases the actual costs of construction within their respective individual corporate limits; and
WHEREAS, it is desirable for this project to be undertaken in a coordinated and comprehensive
manner; and
WHEREAS, the City of Chicago's Department of Transportation has developed a design
contract selection process which includes initial proposals, interviews and negotiations:
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Evanston, Cook
County, Illinois;
SECTION 1: That the above recitals are incorporated herein and made a part hereof.
SECTION 2: That the letting of suborders for the work to be performed hereunder shall be in
accordance with the City of Chicago standards and procedures.
SECTION 3: That the City Manager is hereby authorized to execute an intergovernmental
agreement with the City of Chicago Department of Transportation for the design phase, marked op
Exhibit A and attached hereto and incorporated herein.
SECTION 4 : That the Evanston City Engineer is hereby designated to, assist in the review of
evaluation of the design concept phase.
SECTION 5: That the City of Chicago will not enter into a suborder for the design concept
services without the prior approval of the Evanston City Manager or his designee.
SECTION 6: That the City of Chicago may not award a contract exceeding the estimated cost
set forth herein of $100,000.
SECTION 7: That the City of Evanston is a third party beneficiary of the suborder entered
into by the City of Chicago resulting from this resolution and that any terms establishing rights
and authority in the City of Chicago shall extend to the City of Evanston.
SECTION 8: That the City of Evanston and the City of Chicago agree to cooperate fully, to
execute any and all supplementary documents and to take all additional actions which are
consistent with and which may be necessary or appropriate to give full force and effect too the
basic terms and intent of this agreement and to preserve and assert any claims that a party may
have against an architect and or engineer.

NOW THEREFORE, IN CONSIDERATION OF THE PREMISES AND THE MUTUAL
UNDERSTANDINGS AND AGREEMENTS OF THE PARTIES HERETO, AND IN
CONFORMITY WITH ALL THE APPLICABLE LAWS, IT IS RESOLVED BY THE CITY
COUNCIL OF THE CITY OF EVANSTON :
