HomeMy WebLinkAboutRESOLUTIONS-1997-017-R-97• 17-R-97 A RESOLUTION Authorizing Acceptance of an Easement from Metropolitan Water Reclamation District for a Foot Bridge Across the North Shore Channel WHEREAS, the City of Evanston has a longstanding lease with the Metropolitan Water Reclamation District ("District') concerning certain property of the District along the North Shore Channel ("Channel"); and WHEREAS, said lease has afforded the City the opportunity to sublease a portion of the property to the Evanston Wilmette Golf Course Association for the purpose of the Association developing and administering the Peter N. Jans Golf • Course; and WHEREAS, Resolution 37-R-94 extended the lease between the City and the District to May 31, 2032; and WHEREAS, the City extended its lease with the Evanston Wilmette Golf Course Association to May 31, 2032, authorizing continued operation of the Peter N. Jans Golf Course; and WHEREAS, the foot bridge golfers use to cross the Channel between holes 16 and 17 on the Evanston side of the Golf Course is in need of replacement; and WHEREAS, the new bridge will be designed to allow for use by motorized golf carts, thereby facilitating the crossing of disabled persons; and • WHEREAS, the District has approved the grant of a thirty-five year easement to expire on May 31, 2032, to the City to provide for the bridge; and WHEREAS, the consideration for the easement grant is $1,500.00 (fifteen • hundred dollars); and WHEREAS, the Evanston Wilmette Golf Course Association has agreed to pay said consideration to the District; and WHEREAS, acceptance of the easement is in the best interests of the City, NOW, Therefore, Be it Resolved by the City Council of the City of Evanston, Cook County, Illinois: SECTION 1: That the foregoing recitals are incorporated herein. SECTION 2: That the City hereby accepts the afore described grant of easement for the installation, operation, maintenance, repair and removal of a 12- foot wide foot bridge extending appropriately 160 feet across the North Shore Channel, between two abatement and staging areas, each approximately 25 feet • wide and 50 feet long, upon, under, across and through District land, extending from the top of the bank down the slope thereof, all centered on a line approximately 270 feet northeasterly of and parallel to the east right-of-way line of Green Bay Road in Evanston, Illinois, described in Exhibit A attached hereto and made a part hereof. The City Manager is authorized to execute, and the City Clerk to attest, any and all documents necessary to effect such acceptance. The City Manager is further authorized to negotiate any additional terms and conditions he deems necessary. SECTION 3: That said acceptance is on terms consistent with the City's sublease with the Evanston Wilmette Golf Course Association. 40 • SECTION 4: The City and the Evanston Wilmette Golf Course Association will amend their sublease approximately to reflect this grant of easement. I NC. 8d7 86d 93d 1 • P. 2 17-R-97 EASEMENT SOUTH SIDE OF NORTH SHORE CHANNEL: Exhibit That part of Sanitary District of Chicago property in the Southeast Quarter of Section 12, Township 41 North, Range 13, East of the Third Principal Meridian, in Cook County, Illinois, • described as follows: Commencing at a corner of Sanitary District property on the North line of Noyes Street and the West line of a 16 foot alley lying West of and adjacent to Lot 20, in Block 4 in McCormick Subdivision of 611 1/2 feet North of and adjoining the South 708 1/2 feet East of the Chicago and Northwestern Railway, in the Southeast Quarter of Section 12, Township 41 North, Range 13, East of the Third Principal Meridian, in Cook County, Illinois, approximately 113.84 feet East of the East line of right of way of the Chicago and Northwestern Railway; thence North on the West line of said 16 foot alley, 156.0 feet to a Sanitary District Property corner at the North line of a 16 foot alley, lying North of said Lot 2Q; thence Northwesterly on a line with an angle of 151 degrees, 19 minutes, 30 seconds measured clockwise from the West line of said alley, a distance of 165.0 feet to the top of Bank of the North Shore Channel and the place of beginning, of the herein described easement; thence continuing Northwesterly on the last described line a distance of 31.0 feet; thence Southwesterly at right angles to last described line a distance of 50.0 feet; thence Southeasterly at right angles to the last described line, a distance of 26.0 feet to the top of the North shore Channel Bank; thence Northeasterly 50.24 feet to the place of beginning. n LJ 0 S-07-1995 2 : 53AM FROM B. INC. 8d7 864 93d 1 P. 3 17-R-97 Exhibit A • EASEMENT NORTH SIDE OF NORTH SHORE CHANNEL: That part of Sanitary District of Chicago Property in the Southeast Quarter of Section 12, Township 41 North, Range 13, East of the Third Principal Meridian, in Cook County, Illinois, described as follows: Commencing at a corner of Sanitary District property on the South line of Colfax Street and the center line of vacated Ashland Avenue; thence South on the center line of said vacated Ashland Avenue, 132.05 feet to a Sanitary District property corner; thence Southeasterly on a line with an angle of 153 degrees, 05 minutes measured clockwise from North to Southeast from the center line of vacated Ashland Avenue, a distance of 224.0 ft. to the top of the North Shore Channel Bank and the place of beginning of the herein described easement; thence continuing Southeasterly on the last described line a distance of 28.0 ft.; thence Southwesterly with an angle of 99 degrees, measured from North to West counter clockwise from the last described line, a distance of 50.0 feet; thence Northwesterly with an angle of 81 degrees measured from East to North counter clockwise from last described line a distance of 28.0 feet, to the top of the North Shore Channel Bank; thence Northeasterly 50.0 feet to the place of beginning. • •
