HomeMy WebLinkAboutRESOLUTIONS-1994-013-R-942/9/94 2/22/94 13-R-94 A Resolution Authorizing the City Manager to Enter into An Agreement with Evanston Hospital Corporation for a Playground at Chandler Park WHEREAS, the City owns the real estate at 1028 Central Street upon which Chandler Park is located; and WHEREAS, Chandler Park is a public park situated near Evanston Hospital Corporation's ("EHC") 1000 Central Street Building; and WHEREAS, EHC is desirous of operating a child day care center at its 1000 Central Street Building; and WHEREAS, EHC is further desirous of improving Chandler Park with a playground for use by the children at this child day care center; and WHEREAS, EHC is willing to assume all responsibilities for construction of the playground, and will donate the completed playground to the City, provided that, at times agreed to by the EHC and the City, EHC will have exclusive use of the playground during each day that the child day care center is in operation; and WHEREAS, at times other than those of exclusive use by EHC, the playground will be for use of the public; and WHEREAS, after the playground is donated to the City, responsibility for its future maintenance shall be in accordance 13-R-94 _ . , _9 with the Chandler Park Playground Agreement between the City and EHC; and WHEREAS, the playground will enhance the public's use of Chandler Park; and WHEREAS, the City Council of the City of Evanston has determined that the best interest of the City would be served by accepting the donation of the afore -described playground. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That the City Manager is hereby authorized and directed to sign, and the City Clerk hereby authorized and directed to attest on behalf of the City, an agreement by and between the City and EHC for this construction by EHC, and donation to the City, and subsequent use and operation of the playground, of a playground at Chandler Park, 1028 Central Street. SECTION 2: Said agreement shall be in substantial conformity with that attached hereto as Exhibit A. SECTION 3: The City Manager is hereby authorized and directed to negotiate any additional terms of said agreement as may be determined to be in the best interests of the City.
