HomeMy WebLinkAboutRESOLUTIONS-1992-076-R-9276-R-92 A RESOLUTION Authorizing the ?vhain Street Commons Plat of Subdivision Subject to Certain Occurrence and Conditions WHEREAS, the City Council of the City of Evanston has adopted Ordinance 63-0-92 approving the terms and authorizing the City Manager to execute a redevelopment agreement for the redevelopment of the Main Street Commons Shopping Center; and WHEREAS, it is in the best interests of the people of Evanston that the contemplated redevelopment of the Main Street Commons Shopping Center be implemented; and WHEREAS, the City Council of the City of Evanston has adopted Ordinance 69-0-92 approving the sale of certain property for the redevelopment of the Main Street Commons Shopping Center; and WHEREAS, after the sale of this City property, it is necessary to combine and then subdivide the property with adjoining property to implement the contemplated Main Street Commons Redevelopment Project; and WHEREAS, the Plat of Subdivision attached hereto as Exhibit A, henceforth referred to as the Main Street Commons Plat of Subdivision, contemplates certain actions precedent to its approval, enactment and recording; and WHEREAS, the actions necessary to take place prior to the enactment of the Main Street Commons Plat of Subdivision are to take place at a real estate closing transferring property ownership and enacting a Plat of Vacation duly approved by the City Council of the City of Evanston which vacates a portion of Pitner Avenue; and WHEREAS, these actions are to be followed by other actions at the real estate closing planned to occur immediately upon the recording of the Main Street Commons Plat of Subdivision; NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Evanston, Cook County, Illinois: SECTION 1: That the lrlain Street Commons Plat of Subdivision hereto attached as Exhibit A is hereby approved and shall take effect only upon 1) the purchase of the subject property by LaSalle National Trust N.A. as Trustee under Trust Agreement dated February 20, 1984 and known as Trust No. 107664, except for that portion of the subject property retained by Highland Superstores, Inc., and that portion of the subject property already owned by LaSalle National Trust N.A., as trustee as aforesaid and 2) the enactment and recording of a duly adopted Ordinance of Vacation vacating the western half of that portion of Pitner Avenue, between the center line of Washington and Cleveland Streets. SECTION 2: That this approval of the Main Street Commons Plat Subdivision is subject to the stamp of the County Clerk indicating real estate taxes and special assessment on the property have been paid to date. SECTION 3: That approval of the Main Street Commons Plat of Subdivision attached as Exhibit A is conditioned upon possession by a title company agreeable to the City of the following fully executed documents in a form recordable and intended for recording immediately upon the recording of the Plat of Subdivision: 1) First amendment to Deed of Declaration; 2) First Amendment to Construction, Operation, Maintenance and Reciprocal Easement Agreement; 3) Trustee's Deed from LaSalle Trust No. 107664 to Wal-Mart Stores Inc.; and 4) New Construction, Operations, Maintenance and Reciprocal Easement Agreement. SECTION 4: That the City Manager of the City of Evanston or his designee, administrative officers of the City of Evanston and the City Clerk respectively, are hereby authorized and directed to execute, attest and deliver such documents, agreements and certificates as may be necessary to enact this Plat of Subdivision as herein approved. r n effect followin iis SECTION 5: This resolution shall be in full force and of c g passage and approval in the manner provided by law. i' Mayor ATTEST: r' j / City Clerk i ADOPTED: /J, , 1992 i, 29Y70/71
