HomeMy WebLinkAboutRESOLUTIONS-1992-057-R-927-9-92 •' 57-R-92 A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO A YOUTH JOB SITE TRAINING AGREEMENT WITH THE PRIVATE INDUSTRY COUNCIL OF NORTHERN COOK COUNTY WHEREAS, the Private Industry Council of Northern Cook County has entered into an agreement with the Illinois Department of Commerce and Community Affairs for the sponsorship of an employment and training program for economically disadvantaged youth, and has established a subgrant for the provision of these services; and WHEREAS, an employment and training program for economically disadvantage youth is in the best interest of the citizens of Evanston; and 0 WHEREAS, the Private Industry Council of Northern Cook County is desirous of entering into an agreement with the City of Evanston to provide a job training program for economically disadvantaged youths. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That the City Manager of the City of Evanston, is hereby authorized and directed to sign the aforesaid Training Site Agreement, marked as Exhibit A attached hereto and incorporated herein by reference. THIS AGREE? 4EN- T, is made and entered into this day of , 1992. between the Private industry Council of Northern Cook Countv (PIC) and (acting as Subcontractor, if applicable), and (hereinaiter called the work site). WHEREAS, the Private industry Council of Northern Cook County has entered into an agreement with the Illinois Department of Commerce and Community Affairs for the sponsorship of an employment and training program for economically disadvantaged youth, and has established a subgrant for the provision of these services. THEREFORE, the parties under this Agreement do mutually agree to the provision of the following services in accordance with Part 1: General Conditions and Part II: Position Description(s) as attached. ['art i contains general conditions required of training sites and needs to be signed only once by the site representative/supervisor. Part 11 is specific to individual participants employed at the site and a separate Part If must be completed for each participant assigned to the site. PART I A. The Subcontractor agrees to: 1. Provide counseling to the participants on an on -going basis in a manner not to conflict with the work schedule established at the site. Z Recruit and refer eligible youth to approved Sites. Prior to assigning youth to work site, subcontractor will verify suitability of the training opportunity. 3. Provide PIC with an Employability Development Plan (EDP) when the participant is enrolled and provide updates at two week intervals. Provide the termination record at the end of the t..�r,.�... and other client forms as required. 4. Collect time and attendance reports for each participant using PIC approved time and attendance fortes. The Subcontractor will ensure that all forms are complete prior to submitting the signed time and attendance records to PIC according to an schedule determined by PIC S. Be held liable for all costs incurred where the participant has exceeded the permitted number of hours as outlined in the work site agreement, Part 11, and/or the total time in the activity is over the hours stipulated in the contract. 6. Provide the site supervisor(s) and the participant with a complete orientation to the Summer Youth Employment Program (SYEP), and with information regarding the grievance P& ures- 7. Ensure that the responsibilities of the work site are carried out. B. The Work Site agrees to: 1. Ensure that youth assigned to the Site r"f.,-.-. activities as described in Part IL Position Description. The time spent in the activity shall not exceed hours in can — per pay period; and/or the total hours noted in the appropriate position desaiptiorL 2. Provide contmumm on -site .,sr:.. .,. There should be a supervisor on the r..:...:_ _. at all times. 3. Provide adequate spam equipment, and safe woridng conditions for the participants. This buiudes compliance with child labor laws m accordance with the relevant of Chapter 48 (Employment) of the Illinois Revised Statutes. 101 4. Keep accurate records of participants daily attendance by verifying and approving attendance information recorded on the approved time and attendance corms. S. :assist with participant evaluation procedures. 6. Follow an appropriate disciplinary process for participants who do not follow work site rules. Site supervisors are to provide a positive learning experience for the participant. The Subcontractor will be contacted regarding any concerns or problems before any disciplinary action takes place. 7. Permit on -site visits and observation of participants by authorized representatives of the Subcontractor and/or PIC. C. The PIC agrees to: 1. Pay each participant actively enrolled at an approved training site at the gross rate of $4.50 per hour based on the submission by the Subcontractor of the appropriate supporting documentation. 2. Pay participants only for actual hours worked. Makeup time is not permitted. Lunches are not paid. 3. Insure participants under its Workers Compensation policy. 4. No obligation wiil be incurred by PIC until: (1) this Agreement is approved by all parties, (2) a signed W-4 for the participant is on file with PIC, and (3) all documentation necessary has been received to determine the participant is {TPA eligible. D. The following assurances are made under this agreement: 1. No participant under this Agreement may engage in political or religious activities at a Site or as a condition for placement at a site. 2. No participant who is related to an employer may be assigned to any Site where the Site participates under this Agreement. 3. No participant vill be placed, or position opening filled, when another individual is on layoff from the same or substantially equivalent job, or when an employer has terminated or reduced the workforce with the intent to fill vacancies by participants who are subsidized by JTI'A. No currently employed worker will be displaced by a JTPA participant. 4. The work site shall fully comply with all applicable federal, state, and local laws and regulations, including Equal Emplovment Opportunity (41 CFR 29-70. 216-8) and Illinois Fair Employment Practices (Article VID. 5. No participant may continue at a Site or, upon termination, be hired at a Site if he/she has been terminated from JTPA for administrative causes; i. e., failure to attend. 6. Only not -for -profit, municipal, state, federal or other non-profit sites are authorized to enter into this agreement. E Complaints and Grievances: Complaints may be brought against the work site or Subcontractor (if applicable) by an individual or organization and may include: 1. Complaints alleging a violation of the Job Training Partnership Act, the regulations under the Act, the terms of the grant, or its subgrants, including any complaint with programs operated by its subrecipients. 2. Complaints alleging discrimination by race, color, national origin, sex, age, or religion. 3. Grievances involving personnel practices but not alleging discrimination. 4. Complaints alleging criminal fraud and/or abuse. • 5. Complaints alleging incorrect payment of payroll. 102 F. Termination and Liabiiirr ror ?e-iorrnancr 1. If a participant suffers damages and makes a claim agamst PIC as a result of any acts. comrtussions or omissions of the work site or Subcontractor within the scope of employment, or training, or other terms of this Agreement. the Work site or Subcontractor wtii defend, at its own expense. any suit based on the claim and will pay any resulting judgement or settlement against the PIC 3. In no event shall there by any liability on the part of PIC or any of its agents or offices for payments or the rt.:.,...amue of obligations undertaken by the work site or Subcontractor to excel of funds furnished to PIC by the United States Department of labor and/or State of Illinois Department of Commerce and Community Affairs. 4. If, through any cause, the work site or Subcontractor shall fail to fulfill in a timely and proper manner his obligations under this Agreement, or if the work site or Subcontractor snail violate anv of the covenants. agreements or stipulations of the Agreement. PIC shall thereupon have the right to terminate this Agreement by giving written nonce to the work site or Subcontractor of such termination and speciiv the effective date thereof, at least five days before the effective date of such termination. This Agreement shall terminate in full, or in part, at the discretion of PIC in the event that PIC suffers a loss of funding or termination of the grant which permits it to fund, in full or in part, the work site or Subcontractor. In the event PIC suffers such a loss of funding in full or in part. PIC shall give the work site or Subcontractor written notice which shall set forth the effective date of full or partial termination, or if a change in funding is required, setting forth the change in funding and the changes in the approved budget. The parties agree to all the terms and conditions contained in the Agreement and to Part If: Position Desmptions, as developed.
