HomeMy WebLinkAboutRESOLUTIONS-1992-044-R-926-4-92 J 44-R-92 A RESOLUTION Library Construction WHEREAS, the City of Evanston Main Public Library at 1703 Orrington will be razed and replaced with a new structure to better serve the community; and WHEREAS, demolition and construction is scheduled to begin in 1992; and WHEREAS, said demolition and construction will require the relocation of the activities and operations of the Library; and WHEREAS, the City has entered into a lease for a portion of 1600 Orrington (The Fountain Square Building) for a ' temporary library facility; and WHEREAS, the expeditious construction of the new library at 1703 Orrington will reduce the total lease cost for the temporary library location; and WHEREAS, the expeditious completion of the library construction will best serve the interests of all citizens by insuring the delivery of high quality library services; and WHEREAS, the City after the review of thirteen (13) proposals entered into a construction consultant contract with U. S. Equities; and WHEREAS, U. S. Equities has reviewed the architectual drawings, proposed construction objectives and consulted with the Library Board and the Library Project Program Committee; and 44-R -92 WHEREAS, Title 1-17-1 of the City Code provides that . "the City Manager... with the approval of the City Council- may award contract to a bidder other than the lowest bidder if it should be determined that said action would be in the best interest of the City"; and WHEREAS, U. S. Equities has recommended that the general contractor retained for the construction of the new library be involved in the development of the construction documents; and WHEREAS, the involvement of the general contractor in the development of the construction documents will allow the award for demolition and asbestos abatement and other related subcontracts in a prompt and efficient manner; and WHEREAS, City Council has determined that the recommendation of U. S. Equities will reduce the projected cost . of the library construction. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That the attached General Contractor Selection proposal marked as Exhibit A, is in the best interest of the City and that the City Council does adopt said General Selection Proposal as the basis to select and - retain a general contractor for the library construction. SECTION 2: That this Resolution shall take and effect and be in full force from and after its passage as provided by law. 2 44-R-92 ATTEST: Clerk r Adopted: C1 Xn, 1992 0 0 Mayor EXHIBIT A EVANSTON PUBLIC LIBRARY GENERAL CONTRACTOR SELECTION May 18, 1992 To help insure that this sophisticated, complex project is completed in accordance with the proposed budget and schedule, the general contractor must be made part of the project design team, and should be retained before the Architect completes the construction drawings and specifications. Retaining the general contractor as early as possible will provide the following advantages: 1. As this project will include somewhat complex systems consisting of, for example, the exterior wall and roof structure, and various special systems, it is important that the general contractor fully understand the scope of work and the division of responsibility for each system. The general contractor will have the opportunity to develop this understanding as a result of being involved in the design process. The general contractor's cost estimates will be much more reliable, and change orders will be minimized. 2. It will be possible to obtain construction cost and material lead time information throughout the construction document prepara- Is tion process. This will eliminate a large portion of the risk that the final cost of construction will exceed the budget when the general contract is bid and awarded after 100% completed construction documents are issued. If this situation does occur, it will be necessary either to increase the project budget or to incur schedule delays by redesigning the project and rebidding the general contract. By involving the general contractor in the process of developing the construction documents, it will be possible for the Architect and the City of Evanston to make decisions which are supported by current market information. This should ultimately result in obtaining the best value for the cost and still maintain the architectural and functional qualities of the design. 3. It will be possible to award subcontracts for demolition and asbestos abatement, caissons, excavation, site utilities, and foundations prior to completion of construction documents. This will allow the project to begin shortly after the Library relocates to the temporary facilities at 1600 Orrington. Based on the proposed schedule, the move to 1600 Orrington will be completed L-1 GENERAL CONTRACTOR SELECTION . May 18, 1992 Page 2 in October, 1992, but the construction documents will not be completed until January 1, 1993. If the General Contract is awarded in the conventional manner, after the construction documents are 100% completed, with allowances made for contract bidding, award and procurement of permits, it will probably not be possible to start construction of the new building until March, 1993. If the general contract is awarded in the conventional manner, the proposed schedule will be extended by six months, and the cost of the project will increase marginally, primarily as a result of rent payments on the temporary space which. commence on July 1, 1992. The general contractor could be retained prior to completion of construction documents by the following process: 1. The City of Evanston will request general contractors to submit qualifications for this project based on a specific set of criteria . which will include: financial strength, experience with similar type and size of project, and the contractor's past performance meeting affirmative action goals. Qualifications will be requested by advertisement or by any other normal method used by the City. 2. Qualifications will be received and reviewed by the City with the assistance of U.S. Equities Development, and a "short list" of qualified general contractors will be developed, from whom proposals vrill be requested. 3. Each qualified general contractor will be requested to submit a proposal to provide preconstruction consulting services to include budget and scheduling activities, their proposed fee computed on a percentage of construction costs, and their proposed general conditions costs which will also be computed as a percentage of construction costs. The general contractor will also submit as part of their proposal a commitment for minority and disadvantaged business participation. The proposals will be submitted and the general contract will be awarded on the proposal with the under- standing that the general contractor will be required to provide r� • GENERAL CONTRACTOR SELECTION May 18, 1992 Page 3 two Guaranteed Maximum Prices (GMP) for the project, as described below. 4. The first Guaranteed Maximum Price (GMP-1) will be determined on the basis of 75% (or some other agreed upon percentage) complete construction documents, and will include direct trade costs, allowances, General Conditions, general contractor's fee, and an agreed upon contingency allowance. The general contractor's fee and general conditions budget will be fixed when GMP-1 is accepted by the Owner. All cost information will be on an "open - book" basis. After GMP-1 is submitted, the City will have the option either to accept the general contractor's GMP-1 and proceed with the project, redesign the project and revise GMP-1 to conform to the project budget, or cancel the agreement with the general contrac- tor for costs incurred for pre -construction consulting services. If GMP-1 is acceptable and the project proceeds, the City will iretain the rights to redesign the project or cancel the General Contract in the event that the market changes, or for its conve- nience. 5. The second Guaranteed Maximum Price (GMP-2) will be determined after the construction documents are 100% completed and the general contractor has competitively bid and awarded the major sub contracts. GMP-2 will be computed as the sum of the following: a) sum of major trade subcontract awards b) sum of mutually agreed upon budget amounts for the balance of unawarded subcontracts c) sum of allowances d) the general contractor's fee as agreed to as part of GMP-1 e) The General Conditions costs as agreed to as part of GMP-1 f) A stipulated contingency of 57o (or some other agreed to amount) 0 GENERAL CONTRACTOR SELECTION May 18, 1992 Page 4 The adjustment from GMP-1 to GMP-2 will be made- only if GMP-2 is less than GMP-1. A shared savings provision may be included in the General Contract agreement to provide the general contractor with incentive to save money in the trade buy-outs by either aggressively negotiating subcontract agreements or providing subcontractor initiated "value engineering" alternatives to the design.
