HomeMy WebLinkAbout073-R-178/23/2017 73-R-17 A RESOLUTION Authorizing the Settlement of all Litigation and Claims with Trinette Lark, Bria Diaz, and Prince Ford WHEREAS, since 2016, the City and nine (9) Police Officer Defendants defended claims brought against them by Trinette Lark, Bria Diaz, and Prince Ford (collectively referred to herein as "Plaintiffs") in case no. 16-cv-04630 in the United States District Court for the Northern District of Illinois, Eastern Division; and WHEREAS, this litigation pertained to an incident between the parties on April 26, 2015; and WHEREAS, Plaintiffs, residents of Evanston, Illinois, seek to settle all claims pursuant to the terms of a release and settlement agreement negotiated by counsel of record for the City, Police Officer Defendants, and Plaintiffs; and WHEREAS, in compliance with Section 2(e) of the Open Meetings Act, 5 ILCS 120/2(e), the City seeks final action on settlement of this litigation in open session before the public; and WHEREAS, upon Plaintiffs' execution of the settlement agreement, the City will pay Plaintiffs a total of fifty thousand dollars ($50,000) ("Settlement Payment"); and WHEREAS, Plaintiffs must dismiss with prejudice all claims brought against the City and the City Police Officer Defendants in case no. 16-cv-04630. 73-R-17 NOW BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: The City Manager is hereby authorized to execute the Settlement Agreement with Plaintiffs. The Settlement Agreement will be approved as to form by the City's Corporation Counsel prior to execution. SECTION 2: Resolution 73-R-17 shall be in full force and effect from and after its passage and approval, in the manner provided by law. Attest: Devon Reid, City Clerk Adopted: ! i,, 2017 Stephen F4.
